South Dakota’s Individual Insurance Policy Regulations
- Insurance companies are not required to cover every applicant who submits a request for individual insurance.
- Individual insurance policies are required to cover certain services, including hospital stays after delivering a baby.
- Insurance companies can exclude pre-existing conditions, or conditions which occurred within one year of when the individual policy is awarded, for up to one year, and in some cases, can permanently exclude the conditions.
- Your insurance policy can be canceled for reasons including non-payment of premiums and fraud, but not because you become ill.

South Dakota State Insurance Assistance
- You may be eligible for South Dakota’s Risk Pool if you are a South Dakota resident, if you are not covered by any other health insurance plan including Medicare or Medicaid, if you have exhausted any COBRA benefits that you may have had, and if you have had a minimum of one year’s worth of ongoing insurance coverage. In addition, you must apply to the Risk Pool within 63 days of the termination of your insurance policy.
- Children’s Health Insurance Program offers children from qualified low income families healthcare coverage, including hospitalization and prescription drugs.
